1. Acceptance of Terms

By accessing and using MyHeadshots.Pro ("Website" or "Service"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use this Website.

2. Service Description

The Website provides an online platform where users can submit personal photos and, in return, receive AI-generated headshots. While the Website makes best efforts to return headshot images that closely resemble the submitted user photos, there may be instances where the results are not as expected due to the inherent imperfections in any new technology. Consequently, some of the images returned may not be usable. The Service is provided on an "as is" basis without any guarantees. No refunds will be provided under any circumstances.

3. Process and User Requirements

To generate the AI headshots, our platform needs to understand what you look like. This is done by training a computer model using the photos you provide.

3.1 Image Requirements:

• Type and Size: It's recommended to submit images that are square and close to the face to achieve optimal results.
• Variability: For the best results, it's recommended to provide photos taken at different times and under various lighting conditions. This variability gives the computer model a more comprehensive understanding of your features and enhances the accuracy of the generated headshot.
• Quantity: A minimum of 4 images is required to effectively train the model. However, providing more images can improve the quality and accuracy of the generated headshots.
• Total Upload Size: The combined size of all the uploaded images should not exceed 4.5MB. Please ensure your images adhere to this limit to prevent any upload issues.

4. User Responsibilities

(a) You are solely responsible for the photos you submit.

(b) You warrant that you have all necessary rights to the photos you upload and that they do not infringe upon any third party's rights.

5. Intellectual Property

The content, design, and processes of this Website are the property of MyHeadshots.Pro and are protected by Canadian and international copyright laws. Unauthorized use of this intellectual property is prohibited.

6. Limitation of Liability

(a) MyHeadshots.Pro, its affiliates, and service providers will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use of or inability to use the Service.

(b) This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses, even if MyHeadshots.Pro has been advised of the possibility of such damages.

(c) MyHeadshots.Pro is not responsible for errors, inappropriate images returned, cyberattacks, or data breaches.

7. Indemnification

You agree to indemnify and hold MyHeadshots.Pro, its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, legal and accounting fees, arising out of or in any way connected with your access to or use of the Website or your violation of these Terms.

8. Changes to Terms

MyHeadshots.Pro reserves the right to modify these Terms at any time. It is your responsibility to review these Terms regularly. Continued use of the Website after changes to these Terms signifies your agreement to such changes.

9. Governing Law

These Terms will be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

10. Termination

MyHeadshots.Pro reserves the right to terminate your access to the Website and the Service at its sole discretion, without notice, for conduct that it believes violates these Terms or is harmful to other users, MyHeadshots.Pro, or third parties, or for other conduct which MyHeadshots.Pro deems inappropriate.

12. Ownership and Usage of Images

(a) Customer's Ownership: The AI-generated headshots provided to you as a result of using our Service are your property. You have full ownership and rights to these output images.

(b) Customer's Photos: MyHeadshots.Pro respects your privacy and rights. We will not use, distribute, sell, or display the personal photos you upload to our platform. Once the AI headshot generation process is complete, your uploaded photos are not stored or used for any other purposes.
